Texas legality and reseller certificates
Two questions come up early for new operators: can I sell peptides in Texas, and what is a reseller certificate? Neither has a one word answer. This page lays out the separate decisions involved so you know who to ask.
Is it legal to sell peptides in Texas?
It is not a blanket yes or no. The answer depends on the exact product and on what your whole sales presentation communicates: label, website, buyer, supply route and transaction.
FDA has treated named products as unapproved drugs when websites showed intended human use, even though the labels said research use only. A research label is a statement regulators examine, not a legal shield.
- Product rules: FDA intended use and the Texas DSHS Drug Manufacturers and Distributors page.
- Tax registration: the Texas Comptroller sales tax permit application.
- Company formation: a certificate of formation filed with the Texas Secretary of State.
- Platform review: your payment processor and storefront set their own private policies.
What is a peptide reseller certificate?
The phrase can mean two different documents. One is a state sales tax resale certificate for a qualifying purchase. The other is a supplier's own authorization to resell its products.
In Texas, a seller can skip collecting tax on an item bought for resale when it accepts a properly completed Form 01-339. A sales tax permit number or a copy of the permit does not replace that certificate.
A resale certificate settles the tax treatment of a purchase. It does not grant supplier permission, and it does not settle product rules. Ask your supplier which document it wants, then check with the relevant state authority.
Keep a written decision file
For each product and sales model, record the question, the source you checked, the date, and the answer you received. Where a rule has not been established for your facts, get the current answer from the responsible agency or qualified counsel before treating the idea as cleared.
This page is business education, not legal, tax or medical advice. Rules change and vary by product and location. Confirm your situation with the responsible agency or a qualified professional.
