Can You Sell Peptides on eBay? What the Drug Policy Says (2026)

Can you sell peptides on eBay?

eBay's prescription and over the counter drugs policy, read on October 26, 2026, says "Prescription drugs, or products containing prescription-strength medication, aren't allowed", and it also bars substances made to be given by needle, vitamins included, "regardless of whether they’re available over the counter" (eBay). eBay gives 4 example actions it may take against a listing that breaks the policy, including account suspension, and no part of the policy mentions a research use only exception.

That is the direct answer. The rest of this guide reads eBay's drug policy and its medical devices policy line by line, sets them next to what FDA wrote to three peptide sellers in 2026, compares eBay with Amazon, and ends with a checklist, a glossary and the full source list. Every quotation was copied from a page captured on October 26, 2026.

Which eBay policies apply to a peptide listing?

Three eBay help pages touch a peptide catalog. The drug policy is the main one, the medical devices policy covers needles and lab equipment, and the illegal drugs policy covers paraphernalia. The table shows what each page says about itself and whether we could read it in full.

Removed or hidden listings"We may have to remove or hide a listing if it doesn't follow our policies or if the rights owner asks us to."Summary onlyeBay 5048

The illegal drugs summary line in the table comes from the drug policy page, which links to that policy and quotes its first sentence. We did not read the illegal drugs page itself, and this guide states nothing about it beyond that one line.

What does eBay's drug policy say, rule by rule?

The policy opens with a two part summary: "Prescription drugs, or products containing prescription-strength medication, are not allowed. Over-the-counter medications, herbal products, vitamins and veterinary medicines must follow guidelines for listing" (eBay). A second sentence states the aim: "Our policy aims to make sure that listings meet strict health and safety regulations."

Under the heading "What is the policy?", eBay lists its rules as single lines. The first is the prescription bar. The second points to an outside list: "Tainted supplements identified in the FDA database". The page links that line to FDA rather than repeating FDA's list, so the FDA database itself is the source for which supplements it covers.

The rules that follow fall into four groups: over the counter medicines, herbal and drug-like remedies, vitamins and supplements, and a set of outright bans. The sections below take each group in turn, because each one sets a different condition a listing must meet.

What must an over the counter medicine listing show?

eBay sets three conditions for over the counter medication "containing non-prescription-strength drugs" (eBay). The listing must "Clearly state the concentration of the prescription drug in the Item Specific provided". The product must "Not be expired prior to reaching the buyer, and clearly state the expiration in the description". It must also "Be in new, unused condition and in the original, unopened and undamaged packaging".

Those three lines describe how a permitted medicine is listed. They do not create a category for products sold under a research label, and the page names no such category anywhere. We searched the captured text for the words peptide, research and laboratory and found each 0 times.

Can a listing make health claims or compare a product to a prescription drug?

No. The policy says that "Listings for herbal, holistic, or drug-like remedies and legal substances" may not make health claims that FDA has not approved, and may not "be compared to any prescription drug" (eBay).

The rule covers what a listing says, not only what a product is. A listing title, a description or an item specific that ties a product to a prescription drug by name falls under the comparison bar as eBay writes it. This matters for peptide sellers, because many research products are named after the drug a compound resembles.

The same idea appears in federal advertising law. Under 15 U.S.C. 55, a false advertisement is one "which is misleading in a material respect" (Cornell LII, 15 U.S.C. 55), and 15 U.S.C. 52 makes it unlawful "to disseminate, or cause to be disseminated, any false advertisement" to induce the purchase of drugs (Cornell LII, 15 U.S.C. 52).

What does eBay require of vitamins and supplements?

eBay writes that "Vitamins and supplements must be in new, unused condition and in the original, unopened and undamaged packaging" (eBay). It adds: "They must not be expired, with the expiration date entered in the item specifics".

A separate line applies to every listing in the policy: "All required labelling information must be in English". The medical devices policy has a matching rule for devices, covered below. Neither page says that a translated insert or a seller's own label meets the requirement; both describe the original labeling.

Which products does eBay's drug policy ban outright?

Besides prescription products, the policy names several bans in plain terms. The table lists each, with the page it comes from.

Banned itemeBay's wordingSource
Prescription products"Prescription drugs, or products containing prescription-strength medication, aren't allowed"eBay 5048
Substances made to be given by needleBanned, vitamins included, "regardless of whether they’re available over the counter"eBay 5048

Veterinary medicines without US authorization"Does not have a marketing authorization for sale in the US"eBay 5048
Repackaged medicines"Repackaged over-the-counter medications, including flea and tick medications"eBay 5048

The needle rule is the one most peptide catalogs meet first. It does not turn on whether a product needs a prescription: eBay applies it to products sold over the counter as well.

Does eBay mention peptides or research use only products?

No. The drug policy, as captured on October 26, 2026, contains the word peptide 0 times, the word research 0 times and the word laboratory 0 times (eBay). The medical devices policy captured the same day shows the same three zeros (eBay).

A zero is a count of words on two pages, not a ruling. It means neither page creates an exception for research labels, so a research product listed on eBay is judged by the same lines as every other drug-like product.

What does eBay's medical devices policy add?

The medical devices policy opens with three sentences: "Medical devices that require a prescription can't be sold on eBay. Medical equipment that could be abused for unlawful means is also not permitted. Listings for items that are permitted must follow our policy" (eBay).

The page then names 13 kinds of prescription devices it bars, among them contact lenses, hearing aids that require a prescription and implantable devices. In a separate list of equipment "which can be abused for unlawful purposes", it names 2 items that are not permitted:

  • "Items or devices that could be abused to facilitate the manufacture of illegal drugs or pharmaceutical products"
  • "Needles, with or without a disposable syringe"

The first item is written broadly. It names equipment by what it "could" be used for, and it covers pharmaceutical products as well as illegal drugs. The page gives no list of which lab tools fall inside it.

Can you sell syringes, vials or lab supplies on eBay?

Syringes without needles, yes, by eBay's own wording; needles, no. Under "The following items can be sold", the policy says "New disposable syringes can be listed, but needles cannot be included" (eBay).

The same list allows "Over-the-counter (OTC) medical devices" and vintage or collectible devices, with a condition on the second: "listings must state that these are not intended for use". The page does not mention vials, scales or other lab supplies by name.

For any lab supply, the open question is the broad line about items that "could be abused to facilitate the manufacture of illegal drugs or pharmaceutical products". eBay does not say how it applies that line to a given item. Only eBay can answer that for a specific listing.

What listing rules does the medical devices policy set?

Permitted devices carry their own listing rules. The table copies them from the page.

Listing ruleeBay's wordingSource
Label language"Original labels on medical devices must include uses, directions, and warnings in English"eBay 4322
Used items"Used items must be properly cleaned"eBay 4322
No changes"Used items must not be altered in any way that changes the performance or safety specifications of the device"eBay 4322
Expiry date"The item description should clearly state the product expiration date"eBay 4322
Delivery timing"Items must reach the buyer before the expiration date"eBay 4322

The policy also asks that listings "state in the item description if the device has been opened or used". These rules sit beside the drug policy's rules on packaging and expiry; both pages put the expiration date in the listing itself.

What can eBay do if a listing breaks these rules?

Both policy pages end with the same enforcement paragraph. It says activity on eBay "is required to follow this policy, the eBay User Agreement and all applicable laws, as well as respect the rights of third parties" (eBay).

If a listing does not, eBay "may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so." It names 4 example actions: "Removing the listing or other content, issuing a warning, restricting activity or account suspension". The words "as an example only" come before that list, so it is not complete.

The drug policy adds a tip for sellers already affected. It says to "Visit Seller Help" to "find details of any policy issues with your account or listings, and get the information you need to quickly resolve them." The page names no separate appeal route for drug listings.

Why does eBay say it has these rules?

eBay gives a reason on each page. The drug policy says: "We don't allow the listing of prescription drugs, and restrict the listing of other drugs, to protect the safety of our members, and to follow government regulations" (eBay).

The medical devices policy gives a parallel reason: "This policy helps to protect the safety of our members while ensuring that important government regulations are followed" (eBay). Both reasons point to government rules, which is why FDA's view of a product matters to an eBay listing.

The drug policy's helpful links go to FDA too. Its only outside link under "Helpful links" is a page of FDA tips for buying drugs online, and its supplement rule links to FDA's database of tainted supplements.

Where does eBay's drug policy point to FDA?

The drug policy names FDA 4 times, and each mention ties an eBay rule to an FDA source. The table lists them in page order.

Where FDA appearsWhat eBay saysSource
Supplement rule"Tainted supplements identified in the FDA database"eBay 5048

Veterinary ruleMedicines classified as General Sales List or Over-the-Counter "by the FDA's Center for Veterinary Medicine" may be soldeBay 5048

eBay does not restate FDA's rules on its own page. Where a rule depends on FDA, the page links to FDA, so FDA's current view is part of how the eBay rule reads on any given day.

What does federal false advertising law add to eBay's claims rule?

eBay's claims rule and federal law overlap. 15 U.S.C. 52(a) makes it unlawful for "any person, partnership, or corporation to disseminate, or cause to be disseminated, any false advertisement" to induce the purchase of food, drugs, devices, services or cosmetics (Cornell LII, 15 U.S.C. 52).

Section 52(b) adds that spreading such an advertisement "shall be an unfair or deceptive act or practice in or affecting commerce within the meaning of section 45 of this title." An eBay listing is written by the seller, so the seller is the person who disseminates it. This guide does not judge whether any listing meets that test; it notes that the statute reaches the person who publishes the advertisement.

How does FDA decide whether a research product is a drug?

FDA looks at intended use, and its rule says the label is only part of the evidence. Under 21 CFR 201.128, intended use is "the objective intent of the persons legally responsible for the labeling of an article (or their representatives)" (eCFR).

The rule lists where that intent can show. It "may be shown by such persons' expressions, the design or composition of the article, or by the circumstances surrounding the distribution of the article." It can also be shown "by labeling claims, advertising matter, or oral or written statements by such persons or their representatives."

One sentence in the rule speaks to resellers directly. It says that "If, for example, a packer, distributor, or seller intends an article for different uses than those intended by the person from whom he or she received the article, such packer, distributor, or seller is required to supply adequate labeling in accordance with the new intended uses." On a marketplace, the seller writes the listing, so the listing is part of what the rule calls advertising matter.

What did FDA write to peptide sellers about research labels in 2026?

FDA's Center for Drug Evaluation and Research posted letters to three peptide sellers in 2026 that we captured on October 26, 2026. Each quoted the seller's research label, then explained why it did not settle the question.

The Gram Peptides letter is dated March 31, 2026 and carries reference 721806. FDA reviewed the seller's website "from January to March 2026" and noted statements on the labeling such as "Research Use Only" (FDA). FDA wrote that despite those statements, "evidence obtained from your website establishes that your products are intended to be drugs".

The NuScience Peptides LLC letter, reference 733652, is dated August 24, 2026 and covers a website review "in July 2026". In a footnote, FDA noted the label phrase "for laboratory, research, and analytical use" (FDA). The Peptide Partners LLC letter, reference 735063, carries the same date and quotes "for research use only" (FDA).

What evidence did FDA rely on besides the label?

FDA quoted product page text at length in all three letters. Each letter introduces those quotes with the same sentence: "Examples from your product labeling, including on your website, that provide evidence of the intended use (as defined in 21 CFR 201.128) of these products as drugs include, but may not be limited to, the following" (FDA). We do not repeat the quoted text, because it consists of health claims.

FDA also looked at how products were sold together. In each letter it wrote that "The sale of these products together demonstrates that you intend for your" companion liquid to be used with the peptides. The NuScience letter also noted a "peptide calculator" on the seller's site (FDA).

For an eBay seller, the parallel is the listing itself. A title, the photos, the item specifics and the other items in the same store are what a buyer and a reviewer see. The letters show FDA reading that whole picture rather than one label line.

Which laws did FDA cite, and what do they mean?

The letters cite the Federal Food, Drug, and Cosmetic Act. FDA called the products drugs under "section 201(g)(1) of the FD&C Act" and new drugs because they "are not generally recognized as safe and effective (GRASE)" for the uses in their labeling (FDA).

The consequence follows from approval. FDA wrote that "No approved applications pursuant to section 505 of the FD&C Act" were in effect for the products. The NuScience letter states that introducing or delivering the products into interstate commerce "violates sections 301(d) and 505(a) of the FD&C Act".

FDA also warned that its list was not complete. The NuScience letter says: "This is not intended to be an all-inclusive list of the violations that may exist in connection with your products or operations." (FDA). The Gram Peptides letter names "seizure and injunction" among the actions that may follow a weak response (FDA).

How fast did FDA expect an answer?

Within weeks. The two August letters ask for a reply "within fifteen (15) business days of receipt of this letter" (FDA), and the Gram Peptides letter asks for one "within fifteen working days of receipt of this letter" (FDA).

The letters are public. The August letters say "Please note FDA posts warning letters on www.fda.gov." That makes a letter readable by anyone, including the marketplace a seller lists on.

How does eBay compare with Amazon on peptides?

Amazon's drugs and drug paraphernalia policy, read the same day, names one peptide class: it lists "GLP-1 (Glucagon-like peptide-1) agonists" among prohibited prescription drugs (Amazon). eBay names no peptide at all. The table sets the two side by side.

How do eBay's rules differ by product type?

The drug policy and the devices policy set different conditions for different kinds of products. The table puts the main ones in one place, each from the page that states it.

Product typeWhat eBay allowsCondition eBay setsSource
Prescription drugsNot allowedNone; the bar is outrighteBay 5048

Prescription devicesNot allowedNoneeBay 4322

Every allowed row carries a condition, and two of the conditions are about the original packaging. A peptide catalog meets the needle row and the prescription rows first, and the conditions on the allowed rows only matter for products that clear those bars.

What do eBay's rules mean for kits and bundles?

eBay's rules work on single items, while FDA's 2026 letters looked at items sold together. eBay's medical devices policy bars "Needles, with or without a disposable syringe" and allows syringes only when "needles cannot be included" (eBay). Its drugs policy bars "Repackaged over-the-counter medications" (eBay). A kit that pairs a vial with a needle meets the needle bar on eBay's wording alone.

FDA's letters add a second angle. In each one, FDA wrote that "The sale of these products together demonstrates that you intend for your" companion liquid to be used with the peptides, and it treated that liquid as a drug as well (FDA). In the letters, the bundle was evidence of intended use, not only a packaging choice.

Put side by side, the two sources point at the same thing: what is sold together, and how it is described, is part of what a reviewer weighs. That is our reading of the two sources together; neither source says it in those words, and neither names eBay bundles.

What should you ask eBay before you list?

The pages leave some questions for eBay to answer about a specific item. Ask them through Seller Help, which the drug policy names as the place to "find details of any policy issues with your account or listings" (eBay), and keep the replies.

1. Does eBay treat a given product as a prescription product, or as one containing "prescription-strength medication"?

2. Does a vial, a scale or another lab supply fall under the line on items that "could be abused to facilitate the manufacture of illegal drugs or pharmaceutical products" (eBay)?

3. Which items does the illegal drugs and drug paraphernalia policy list, since that page was not readable for us?

4. Does a listing title that uses a compound's name count as a comparison to a prescription drug under the drug policy?

5. If a listing is removed, what does Seller Help need to review it?

Which eBay pages could we not read?

Two eBay help pages returned a security check page instead of the policy when we tried to open them on October 26, 2026: the illegal drugs and drug paraphernalia policy (id 4333) and a second help page (id 5271). We did not try to get past the check. This guide quotes only the summary of the illegal drugs policy that appears on the drug policy page.

That gap matters for one question in particular: which lab equipment eBay treats as drug paraphernalia. The full paraphernalia list lives on the page we could not read, so check it yourself before you list any equipment.

What should a peptide brand check before listing on eBay?

These steps follow the policy text and FDA's rule quoted above. They describe what to read and ask, not what any reader's answer will be.

1. Read eBay's drug policy and medical devices policy in full on the day you list, since we read them on October 26, 2026 (eBay).

2. Match each product to the prescription bar and the needle rule before anything else.

3. Read each title and description for any comparison to a prescription drug, which the policy bars in plain words.

4. Check every accessory against the line on items that "could be abused to facilitate the manufacture of illegal drugs or pharmaceutical products" (eBay).

5. Read your listings the way 21 CFR 201.128 does: labeling claims, advertising matter and the circumstances of the sale (eCFR).

6. Search FDA's posted warning letters for each compound you sell.

7. Ask eBay through Seller Help about anything the pages leave open, and keep the written answer.
